BRUSSELS (ChatnewsTV) — The European Union Council has approved the declaration establishing a common understanding of how international law applies in cyberspace. The declaration, announced Monday, underscores the EU’s stance that international law is fully relevant and effective in the digital domain, even as threats in cyberspace grow increasingly complex.
The EU’s decision comes amid a rise in malicious cyber activities, including ransomware attacks, which the Council described as a significant threat to the stability of European economies, societies, and daily life. The declaration makes it clear that cyberspace is not an unregulated frontier, and states must adhere to existing international obligations when operating in the digital sphere.
“Cyberspace must not be seen as a lawless domain,” the Council’s statement said. “The international framework, particularly the UN Charter and relevant human rights and humanitarian laws, fully applies in this realm.”
The EU declaration aligns with the United Nations’ ongoing efforts to ensure responsible behavior by states in cyberspace. It affirms the EU’s commitment to the UN framework, repeatedly endorsed by the General Assembly, which calls for compliance with international law to maintain global peace, security, and stability in the digital environment.
In addition, the EU and its member states will continue to work closely with global partners to create a unified, inclusive, and permanent mechanism under the United Nations to advance responsible conduct in cyberspace. This initiative, known as the Programme of Action, aims to solidify global understanding of how international law governs digital operations.
“This declaration represents a crucial step toward enhancing transparency, predictability, and accountability in cyberspace,” said a Council spokesperson. “By promoting a better global consensus on international law’s application to cyberspace, we contribute to stronger global cyber resilience.”
The EU has also committed to supporting third countries by offering training and capacity-building measures on implementing the UN framework of responsible state behavior in cyberspace. This includes helping nations develop their own positions on how international law should apply to digital activities.
This is the first time the EU and its member states have jointly adopted a declaration focused on the application of international law in cyberspace. It follows the endorsement of the UN’s framework of responsible state behavior, a guideline that has been reiterated multiple times by the UN General Assembly.
In April 2024, the European External Action Service (EEAS) presented a draft on the topic to the Horizontal Working Party on Cyber Issues. After months of collaboration with legal experts and EU bodies, a finalized text was agreed upon in early November, receiving formal approval from the Council on November 18, 2024.
With this new declaration, the EU is sending a clear signal that it is possible to reach consensus on digital security, reinforcing the international legal framework’s relevance in an increasingly interconnected world.
