EU Imposes Restrictive Measures in Support of Democracy in Guatemala

The Council of the European Union announced the establishment of a dedicated framework of restrictive measures to support democracy and facilitate a peaceful and orderly transfer of power in Guatemala, this was contained in a press release on Friday.

This decision comes in response to the 2023 general elections in Guatemala, where President-elect Bernardo Arévalo emerged victorious, a fact confirmed by the European Union Election Observation Mission (EOM) to Guatemala. The EU aims to hold accountable those obstructing the democratic transition that should follow the elections.

Josep Borrell, High Representative for Foreign Affairs and Security Policy, expressed the EU’s unwavering commitment to democracy in Guatemala, stating, “The adoption of this framework is part of this commitment. It shows we stand with the people of Guatemala and against those who are undermining the country’s democracy.” He also expressed eagerness to work closely with President ArĂ©valo’s administration and announced his intention to personally witness the transfer of power by traveling to Guatemala.

Under this new framework, the EU gains the ability to impose restrictive measures against individuals and entities responsible for actions undermining democracy, the rule of law, and the peaceful transfer of power in Guatemala. Such actions include persecution or intimidation of public officials, democratically-elected authorities, civil society, media, and judicial operators, as well as financial misconduct related to public funds and unauthorized export of capital.

The restrictive measures include a travel ban for individuals and an asset freeze for both individuals and entities. Additionally, persons and entities within the EU are prohibited from providing funds and economic resources to those listed.

The EU, a longstanding partner of Guatemala, remains committed to supporting inclusive and sustainable development in the country. The promotion and strengthening of democratic governance and the rule of law are integral components of this effort.

Background information provided outlines the official results of the 2023 presidential elections, expressing concern over attempts to undermine election results, and the condemnation of efforts to nullify the results. The statement issued in December 2023 highlighted the EU’s agreement in principle to adopt a framework for targeted restrictive measures against those obstructing a democratic transition.

EU High Representative for Foreign Affairs and Security Policy, Josep Borrell, is set to attend the inauguration of President Bernardo Arévalo on Sunday, 14th January 2024.
